In the state of Georgia, is it legal to take nude photos and distribute them via the internet/sell them?

I'm curious about the laws concerning nude photography in the state of Georgia. Is it legal to take these kinds of photographs and sell/use them online on websites? Anyone know the laws and/or pitfalls of such a venture?

  1. I don't KNOW the laws specifically in Georgia, but knowing Georgia, I would say nudity is probably illegal, and photographs of nudity are probably death sentence material. Dude, GA has the toughest, most draconian anti-sex laws in the nation! I don't know why anyone even lives in that state! The pitfall is this: ignorance of the law is no excuse, and since Bush, most of the constitution is moot; when McCain is president he'll discard the rest of it. Ex post facto laws are OK now, so even if what you plan is legal now, it won't be tomorrow. DON'T DO IT!
  2. I don't know the ins and outs of Georgia law, and I'm not sure about the Internet. Law relating to the Internet is still very much in its embryonic stages.However, here's what I DO know: If your model is a legal adult who knowingly agrees to be in nude photos that you then have published in some publication such as "Playboy" or "Penthouse" (to use two possible examples), you have nothing to fear from legal authorities. If you obtain a nude photo of your model without her knowledge or consent, you have just opened yourself up to being sued. If you take a nude photograph of a minor, that constitutes child pornography.
  3. Your other answers have been completely wrong. There is NO law in Georgia preventing you from taking photographs of nude models, nor is there any law preventing the dissemination of such photos via the internet (both assuming you have permission from the subject). I am a semi-professional photographer in Georgia and have photographed many nude models in my studio and outside. I have also posted those images on my website and other websites. There are, of course, exclusions for the photography of nude minors, and though it is technically not illegal to photograph a nude minor (for instance, http://images.google.com/images?q=sally+mann - Sally Mann's photos), it does open you to suspicion and potential legal/social problems. As for Playboy and the like, a number of models have been photographed for Playboy publications in suburban Fulton County, and even in the North Georgia mountains. You are safe - as long as your model isn't a minor, and you aren't violating any other public indecency statute (you might get in trouble shooting a nude model at the airport).
